From my perspective, 2026 is the year UK Ai regulation stops being a theoretical conversation and starts being a practical compliance workload for every SME that handles client data. Specially for regulated practices — accountancy, legal, financial advice, healthcare, surveying — the combination of the Data (Use and Access) Act 2025 coming into effect, sector regulators publishing more granular Ai guidance, and EU Ai Act high-risk provisions applying from August 2026 means the environment is moving faster than most firms have planned for.
I believe the firms that get ahead of this do three things now. One, understand what’s actually changing (not just the headlines). Two, align their current Ai use with where the rules are going, not where they are today. Three, pick tooling and policies that absorb future changes without rewrites. This post is my attempt at a practical map of the landscape as it stands in early 2026, and how to prepare.
The big picture: UK Ai regulation in 2026
The UK’s approach to Ai is deliberately different from the EU’s. The EU passed a comprehensive horizontal Ai Act. The UK has chosen a “pro-innovation, context-specific” framework — meaning sector regulators (ICO, FCA, CMA, Ofcom, MHRA and others) are expected to apply existing rules to Ai within their remit, with a central co-ordination function and targeted new legislation where gaps are unavoidable.
In practice, this means UK SMEs face multiple regulatory streams rather than a single Ai rulebook. Specially for firms in regulated sectors, your Ai compliance is your ICO compliance plus your sector regulator’s Ai-specific guidance plus, if you handle EU data, EU Ai Act compliance at the relevant risk tier. Apart from this, the Data (Use and Access) Act 2025 has already changed the baseline under which all of these operate.
What the Data (Use and Access) Act 2025 changed
The Data (Use and Access) Act 2025 — commonly shortened to the DUA Act — amended the UK GDPR and DPA 2018 in ways that matter directly for Ai deployment. The detail is technical, but the practical effect for a UK SME using Ai can be summarised in five points.
First, the rules on automated decision-making under Article 22 UK GDPR were significantly loosened. Previously, solely automated decisions with legal or similarly significant effects required one of three narrow exceptions. The DUA Act broadens the exceptions and introduces a “significant decisions” framework that allows more automated decision-making, provided certain safeguards are in place (meaningful human review, explanation rights, challenge rights). For firms using Ai in hiring, lending, pricing or advice, this is the most consequential change.
Second, the Act introduced new lawful-basis clarifications around scientific research and statistical purposes, which are relevant for firms using Ai for analytics and product development. Third, the rules on international data transfers were reformed to make UK-US data flows more manageable. Fourth, the ICO’s enforcement toolkit was modernised. Fifth, and this often gets missed, the Act introduced new transparency obligations for automated processing that produces “significant decisions” — meaning firms must now explain their Ai logic in a way that affected individuals can reasonably understand.

For this piece, the key takeaway is: Article 22 restrictions are looser but the transparency and explanation obligations are stricter. The UK Ai Bill and sector regulators
At the time of writing, the specific shape of a UK Ai Bill is still being finalised, but the direction is clear. Rather than a single horizontal law, the UK is consolidating existing regulator powers and adding targeted gap-fillers — likely focusing on frontier Ai model developers and specific high-risk deployment contexts (healthcare, critical infrastructure, employment decisions).
Specially relevant for UK SMEs is the expectation that sector regulators will each publish more detailed Ai guidance in 2026. The ICO has already published foundational guidance on Ai and data protection; it is updating this with sector-specific annexes. The FCA has published guidance on Ai in financial services (covering SYSC 9 record-keeping, Consumer Duty expectations, and model risk management). The CMA, MHRA, Ofcom and the sector professional bodies (SRA, ICAEW, RICS, GDC) are all working on their equivalents.
I believe this sector-by-sector approach suits UK SMEs better than a horizontal Act would. It means your Ai compliance is grounded in the regulator you already deal with, rather than a new body with unfamiliar expectations. Apart from this, it means the guidance is relevant — an accountant’s ICAEW-aligned Ai guidance speaks to accountancy workflows, not abstract Ai principles.
Sector-specific updates you should be tracking

For ICAEW-regulated accountancy firms, QAD reviewers are increasingly asking about Ai use during practice reviews. We’ve documented the specific questions in our ICAEW + Ai post. The ICAEW fundamental principles apply directly — confidentiality, integrity, professional competence — and the evidence bar is the audit chain.
For SRA-regulated solicitor firms, Principle 7 (confidentiality) and the Code of Conduct continue to apply to Ai-assisted work. Expect thematic SRA guidance on Ai in 2026, likely focused on privilege preservation, Chinese walls, and COLP evidence. We’ve covered the framework in SRA Ai guidance for solicitors.
For FCA-regulated advisors (mortgage, IFA, wealth), SYSC 9 record-keeping and Consumer Duty evidencing are the active pressure points. The FCA has already published Ai guidance covering model risk management and the consumer outcomes framework; expect more granular rules in 2026, specially around AI-assisted advice documentation. The EU Ai Act and UK firms
Apart from this, UK firms with any EU nexus — EU clients, EU staff, EU subsidiaries, EU data processing — need to track the EU Ai Act timeline. The Act came into force in 2024, with staggered application. General-purpose Ai (GPAI) obligations applied from August 2025. High-risk Ai system obligations apply from August 2026 — including most Ai used in recruitment, credit scoring, insurance, employment decisions, and critical infrastructure.
Specially for UK agencies, recruitment consultancies, consultancies with EU clients and financial services firms with EU customers, the August 2026 kick-in will require specific compliance work. This includes risk management systems, data governance, technical documentation, transparency obligations, human oversight requirements, and conformity assessments for specific use cases.
I believe most UK SMEs underestimate the EU Ai Act’s reach. If your Ai system affects individuals in the EU, it is in scope regardless of where your firm is incorporated. The extraterritorial design is intentional and enforcement will, in my view, follow the GDPR playbook — early fines against non-EU firms to establish jurisdiction.
What good preparation looks like
Basis how the firms I work with are approaching 2026, good preparation has five components.
One, a written Ai policy that references the relevant regulators. Not a generic template — one that cites ICAEW Principles, SRA Code, FCA SYSC 9, RICS Rules or Caldicott as applicable. We’ve published a free UK SME Ai policy template that adapts cleanly.

Three, a governed Ai tool with the four structural properties that 2026 regulation is converging on: UK data residency, pre-model PII redaction, tamper-evident audit chain, per-user kill switch. Policies plus a compliant tool form a defensible package.
Four, transparency infrastructure. Under the DUA Act transparency obligations and the EU Ai Act’s explanation requirements, firms need to be able to explain Ai-assisted decisions to affected individuals in reasonable time and detail. Manual reconstruction is painful; structured logs make it trivial.
Five, a review cadence. Ai regulation is moving faster than annual compliance cycles can absorb. Quarterly reviews, triggered updates when a regulator publishes new guidance, and a named owner who tracks the landscape.

Practical steps for Q2 2026
If you’re a managing partner, COLP, DPO or compliance lead reading this, four practical steps for this quarter.
One, read the Data (Use and Access) Act 2025 summary or our DUA Act post and check whether your current Ai use is aligned with the new automated-decision-making rules. Specially if you’re using Ai in hiring, lending, pricing or advice, the transparency obligations have tightened.
Two, if you have EU clients, staff or data processing, map your Ai use against the EU Ai Act high-risk categories. The August 2026 kick-in is not far away. For recruitment Ai specifically, high-risk obligations apply.
Three, write or refresh your Ai policy and pair it with a DPIA for each Ai deployment. The time investment is four hours. The compliance defensibility it buys is years.
Four, evaluate your Ai tooling against the 2026 requirements. If it doesn’t meet UK data residency, pre-model PII redaction, tamper-evident audit and per-user kill switch, it’s the wrong tool for the landscape that’s coming. Where I think the landscape goes next
I believe the back half of 2026 and into 2027 will see three things converge. Consolidation of UK sector-specific Ai guidance into a coherent practitioner-readable framework. ICO enforcement of DUA Act transparency obligations against at least one high-profile non-compliant firm, establishing the standard. And, specially for UK SMEs with EU exposure, the first enforcement actions under the EU Ai Act high-risk provisions.
Apart from this, I expect specific regulator-level Ai certification or accreditation schemes to emerge — probably sector-led, possibly ICO-coordinated. Firms that have already invested in good Ai governance will find certification is a paperwork exercise. Firms that haven’t will find it’s a rewrite.
From my perspective, the path forward is not to predict which specific rule lands when. It’s to pick tooling and practices that sit cleanly under the evolving framework regardless of which specific rule is enacted.
